In North Macedonia, the trademark rights had been regulated in accordance with the Law on Industrial Property.

In accordance with this law, a trademark shall protect a sign which may be represented graphically and which is capable of distinguishing goods or services of one undertaking from those of other undertakings.  A trademark right protects signs capable of distinguishing, in particular: words, letters, numerals, pictures, drawings, combinations of colors, three-dimensional forms, including shapes of goods or their packaging, as well as combinations of these.

The procedure for granting a trademark right shall be initiated by filing a trademark application to the State Office of Industrial Property. The procedure for granting a trademark right may also be initiated by filing an application according to the Madrid Agreement and the Madrid Protocol.

One and the same trademark application may be used for requesting the protection of several goods and services.

Any legal or natural right-owner who had duly filed an application in any of the state members of the Paris Union or WTO shall be granted priority right in the Republic of North Macedonia from the date of filing the first application if that is claimed within six months of the filing date of the first application. Also, the right-owner who exhibits goods or services marked by a specific sign at an officially recognized international exhibition or fair in the Republic of North Macedonia or in any of the member states of the Paris Union or the WTO may request when filing an application that the date of exhibition of the goods or rendering of the services be accorded a priority date, within three months from the date of the closing of the exhibition or fair.
